<\/span>The first thing you need to do is to evaluate whether setting up a REIT is the best option for you. Evaluate your assets, assemble a team of advisors, and make sure all legal requirements are met. <\/span>In Canada, REITs are owned by trustees and are subject to fiduciary laws that are similar to ones applicable to directors of corporations.
REITs benefit from preferential tax treatment \u2013 income is not taxed when income flows to the trustees\u2019 accounts.

<\/span>To qualify as a REIT in Canada;
<\/span>1- Make sure that your REIT is a publicly-traded unit trust.<\/p>\n\n\n\n


2- Registering your company<\/a> to achieve a certificate of incorporation.<\/p>\n\n\n\n


3- Submit all details and documents under the income tax act of Canada<\/a>. You will be required to take two revenue and assets tests that check for the nature and quantity of your assets and their revenue streams, where following criteria must be met;
\u2605<\/strong> 90% of the REIT\u2019s gross revenue is generated from either the rent of the properties, interests, dividends, royalties, or capital gains through the property\u2019s disposition.
\u2605<\/strong> At least 75% of the tax filed for REIT\u2019s properties is generated through the rent of the properties, the interest gained from the mortgages, or from the properties\u2019 dispositions.
\u2605<\/strong> Over a fiscal year, 90% of the fair market value of the REIT\u2019s nonportfolio properties must fall into the category of qualified REIT properties.
\u2605<\/strong> All nonportfolio entities of the REIT must either derive 90% or more of the REIT\u2019s gross revenue directly from maintaining, improving, leasing, or managing properties, or it owns no property other than their legal title.<\/p>\n\n\n\n
